Shipping policy

1. Overview
This Shipping Policy forms part of the agreement between you and Andrew Sutherland t/a Everdon Fine Art (ABN 69 684 788 283) (Everdon Fine Art, we, us or our) and should be read together with our Website Terms of Use, Terms of Sale, Refunds & Returns Policy and Privacy Policy.
We ship Original Paintings, Limited Edition Prints and Open Edition Prints within Australia and internationally using carefully selected couriers, freight providers and fulfilment partners. Orders are handled with care to help ensure that your Artwork arrives safely.
Unless otherwise indicated, defined terms used in this Shipping Policy have the meanings given to them in our Terms of Sale.
If there is any inconsistency between this Shipping Policy and our Terms of Sale, the Terms of Sale prevail to the extent of the inconsistency.
2. Shipping of Artworks
2.1 Original Paintings
Original Paintings are shipped using carefully selected couriers.
Australian deliveries
There is no additional cost for shipping Original Paintings domestically within Australia. All shipping, handling, packaging and insurance costs are included in the purchase price.
Original Paintings are shipped ready to hang within Australia.
International deliveries
International shipping will incur additional costs, which will be quoted by Everdon Fine Art separately for your approval. The quoted amount must be accepted and paid in full by you before the courier is booked.
For international shipping, Original Paintings are professionally de-stretched, rolled and packaged. After delivery, any Original Painting shipped rolled will need to be re-stretched by a professional framer. You will be responsible for arranging and paying the costs of re-stretching and framing (if desired) after delivery. We recommend that you engage an appropriately qualified professional framer for re-stretching and framing.
If you would prefer an Original Painting to be shipped internationally ready to hang rather than rolled, please contact us before placing your Order. We may be able to arrange this at your request, subject to availability and you paying the freight, packaging and insurance costs, which would be quoted separately for your approval. Any such quoted amount must be accepted and paid by you before dispatch.
For international deliveries, you are responsible for all customs duties, import duties, any applicable taxes including VAT and GST, brokerage fees and any similar governmental charges imposed by the destination country unless expressly stated otherwise herein.
2.2 Fine Art Prints
Fine art prints are produced and dispatched by professional fine art printing and fulfilment partners located in Australia or internationally, including providers located closer to the delivery address where this improves production efficiency or delivery times.
There is no additional cost for shipping fine art prints (framed or unframed) within Australia or internationally unless stated otherwise below.
Additional shipping costs may apply for shipping framed fine art prints where the longest edge of the frame exceeds 40 inches. If you order any such framed art print, shipping will be calculated separately and any additional costs will be quoted by Everdon Fine Art for your approval. Any such quoted amount must be accepted and paid by you before dispatch.
Where applicable, Certificates of Authenticity may be shipped separately from the Artwork.
3. Import Duties, Taxes and Customs Charges
For international Orders, you are responsible for any customs duties, import duties, VAT, GST, sales taxes, brokerage fees, handling charges or similar governmental charges imposed in the destination country unless expressly stated otherwise before your Order is accepted.
These charges are not included in our product prices or shipping charges and vary between jurisdictions.
We cannot advise on the duties, taxes or charges payable in your country.
4. Transit Insurance
Where Everdon Fine Art arranges shipment of an Original Painting, the shipment may include transit insurance until delivery, subject to the terms, limits and exclusions of the relevant insurer or carrier.
5. Dispatch and Delivery Estimates
We aim to dispatch Orders as promptly as reasonably practicable after accepting your Order and receiving payment in full.
Some Orders may take longer to prepare, including:
- Original Paintings requiring professional de-stretching;
- framed print orders;
- made-to-order prints; or
- Orders requiring specialised packaging.
Fine art print production and delivery estimates may be displayed on the Website or otherwise advised at the time of purchase.
All dispatch and delivery timeframes are estimates only and are not guaranteed.
To the maximum extent permitted by law, we are not responsible for delays caused by couriers, freight providers, customs authorities, border inspections, international transit disruptions or other circumstances beyond our reasonable control.
Nothing in this clause limits any rights or remedies that cannot lawfully be excluded.
6. Packaging
Artworks are packaged using protective materials and methods reasonably appropriate having regard to the type, size and destination of the Artwork.
Original Paintings may be shipped rolled in protective tubes or ready to hang as described in clause 2.1.
Fine art prints may be shipped rolled, flat-packed or framed depending on the product purchased, its size, destination and fulfilment method.
Unless otherwise agreed, Everdon Fine Art or its service providers and partners will determine the packaging and shipping method reasonably appropriate for each Order.
Every Artwork is carefully packaged with the aim of helping ensure that it arrives in excellent condition.
7. Delivery Addresses
You are responsible for ensuring that the delivery address provided with your Order is accurate and complete.
If an incorrect or incomplete address is supplied, additional freight, return-to-sender, storage, handling or redelivery charges reasonably incurred may be payable by you.
8. Lost or Damaged Artworks
If an Artwork is lost in transit or appears to have been damaged during transit, please notify us at studio@everdon.art as soon as reasonably practicable after you become aware of the issue.
Where reasonably possible, please provide:
- your Order number;
- a description of the issue;
- photographs of the Artwork;
- photographs of the packaging; and
- any other information reasonably requested to assist us in dealing with the carrier or insurer.
Where reasonably possible, we ask that visible transit damage be reported within seven (7) days of delivery. Prompt notification assists us in making claims against carriers and insurers. Failure to notify us within seven days does not affect any rights or remedies you may have under the Australian Consumer Law.
We will assess the issue and provide a suitable remedy in accordance with Australian law. Depending on the circumstances, this may include repair, replacement, refund or another appropriate remedy.
